Call to order: Chairman Bob Piro called the meeting to order at 6:30 PM

Required Informational Meeting on DDA Activities: Chairman Piro called the Informational Meeting to order at 6:35 PM. Discussed the Perry Township DDA Website information added the pavement of Bennett Drive to the list and fund balance as of July, 2020 of $199,158.00. Brian Pfeifle made a motion to Adjourn; seconded by Robert Taylor. All Ayes. Meeting closed at 6:42 PM.

Approval of the Minutes from the January 15, 2020 meeting: Brian Pfeifle made a motion to approve; seconded by Robert Taylor. All Ayes.

 

Treasurer’s Report/Approval: Brian gave an update on the Treasurer’s Report. Joe Audia made a motion to approve the report; seconded by Stacey Matthews. All Ayes.

 

Old Business:

  1. Lansing Road Lighting Project – Broken lighting pole and fixture replaced – Consumers Energy installed the new light pole and LED lamp on Old Lansing Road this last month.
  2. Pavement of Bennett Drive – The pavement is completed on Bennett Drive and the billing is due from the Road Commission soon. The Township and DDA will split the estimated cost of $62,660.00 for the road resurfacing. Actual cost to split is $58,927.45 total.

 

New Business:

  1. Perry Township DDA Website Information update – this was completed in our earlier required Informational Meeting on DDA Activities and will be posted on the Perry Township website.
  1. Update on DDA Activities – discussed several ongoing projects and details of       several area projects.
  2. Lighting – West side of DDA District – Mark Fulks contacted our area Consumers Energy Manager, Kathryn Burkholder to have Consumers assist us with a Quotation on the installation of new lights on the West side of Old Lansing Road similar to the ones installed last year on the East side of the road. Additional comments included asking the City of Perry if they would like to join us in adding lighting from Dollar General on the East side and continuing to Britton Road where we would continue them on Britton Road to Ruess Road.
  1. Robert Piro suggested we get with the Road Commission and see if a white line could be installed (turn lane) before the entrance to Bennett Drive going East. Mark Fulks stated he would get with the Road Commission to see about getting this done.

Approval of the Agenda: Bob Piro suggested we switch Item 5 (new business) and Item 1 so we can discuss Bennett Drive before the 2020 Budget Approval. Brian Pfeifle made a motion to accept the Agenda as modified; seconded by Kris Morse. All Ayes.

Approval of the Minutes from the October 16, 2019 meeting: Joe Audia made the motion to approve the minutes; seconded by Brian Pfeifle. All Ayes.

 

Treasurer’s Report/Approval: Brian Pfeifle, Treasurer discussed the current DDA bills from 10/1/19 thru 1/14/20. The total balance as of today is $204,151.16. Joe Audia made a motion to accept the Treasurer’s report; seconded by Bob Piro. All Ayes.

 

Old Business:

  1. Consumers Energy Lighting Project – Final Bill payment ($8,664.55). Brian noted that the final payment for the Lighting Project was paid on 11/6/2019. Discussed the need to make contact with Kathryn from Consumers Energy regarding the status of the ordered replaced light pole and fixture that was damaged last year. Mark Fulks will get in contact with her.
  2. Spartan Fence Property – Justin Horvath presented to the DDA Board a brief history and overview of the Spartan Fence Property up for sale to PMW (Precision Metal Works) from Haslett, MI. Justin gave the latest update on PMW’s discussion with Spartan Fence; PMW has received a copy of the letter from the Perry Township Board regarding their agreement with the discharge parameters presented to them from Steve Hughes from Hughes Environmental Services who monitors the Morrice Lagoon. Steve gave discharge parameters and product MSDS details from PMW to the State of Michigan EGLE (Dept of Environmental, Great Lakes & Energy) regarding the sewage discharge and EGLE did not see any problem areas or concern. Justin noted that the realtor was going to meet with PMW or Spartan Fence the first of next week.

 

 

 

New Business:

  1. SEDP pledge due $2,500.00 – Discussion and motion was made to approve the yearly   SEDP pledge for $2,500.00 as requested. Stacey Matthews made motion to approve; seconded by Brian Pfeifle.   1. Bennett Drive – discussion about re-surfacing: A review of the past work on Bennett Drive with the DDA paying for resurface work in 2002 in the amount of $10,800.00 and noting that has been the only major maintenance done on the road. Mark Fulks stated that during the Perry Township Board Meeting last week it was noted that the Road Commission gave a high-end estimate of $84,000 to install a layer of asphalt, wedging and seal coat the road. The Board approved spitting the cost of this work with the DDA. Bob Piro noted that Rose Blvd should be looked at for some work and Mark Fulks noted that he would get with Road Commission and look at this for future work; also it was noted that three or so cut-outs in the Bennett Drive road have sunken and should also be noted to the Road Commission. This will be also noted to them. A motion was made by Joe Audia to approve the split of the cost of the road work on Bennett Drive with the Perry Township Board in a not to exceed amount of $42,000.00 (after the sub-grade areas on Bennett Drive are looked at); seconded by Kris Morse. Roll Call vote: Robert Taylor-yes; Bob Piro-yes; Stacey Matthews-yes; Brian Pfeifle-yes; Mark Fulks-yes; Kris Morse-yes; Joe Audia-yes. All Ayes.
  2. DDA membership renewals (2) – Joe Audia and Brian Pfeifle were both presented letters of intent to be considered for another term by the Perry Township Board in their February, 2020 meeting.
  3. Election of Officers – 2020 – The Election occurred: Motion was made to re-elect Robert Piro as Chairman by Brian Pfeifle; seconded by Joe Audia. All Ayes. Vice – Chairman: motion was made by Robert Taylor to keep Adam Elsesser in that position; seconded by Brian Pfeifle; All Ayes. Treasurer: motion by Bob Piro to keep Brian Pfeifle in as Treasurer; seconded by Joe Audia. All Ayes. Secretary: motion to keep Mark Fulks in as Secretary by Brian Pfeifle; seconded by Kris Morse. All Ayes.
  4. 2020 Budget Information & Approval: Bennett Drive road resurfacing was discussed and it was decided to ADD a line item to the new budget of 2020 for the Bennett Drive road work for $42,000. A motion was made by Brian Pfeifle to keep the items the same and add Bennett Drive resurfacing; seconded by Bob Piro. Roll Call vote: Stacey Matthews-yes; Robert Taylor-yes; Kris Morse-yes; Joe Audia-yes; Bob Piro-yes; Mark Fulks-yes; Brian Pfeifle-yes. All Ayes.
  5. By-Law books: It was noted that copies of the DDA Board’s by-law book needs to be given to Stacey Matthews and Kris Morse. Mark Fulks will get with the Township Clerk and get copies to them.
  6. Lighting – West side of DDA district – Lansing Road: It was discussed to get with Consumers Energy and work with them on a proposal for installing lighting along the west side of old Lansing Road (similar to the lighting installed last year on the East side of Lansing Road. Mark Fulks will get with Kathryn from Consumers Energy and follow up.

Approval of the Minutes from the Sept. 17, 2019 meeting: Brian Pfeifle made a motion to accept the Minutes of 9/17/19; seconded by Robert Taylor. All Ayes.

 

Treasurer’s Report/Approval: Brian reported on the treasurer’s report as presented to the Board. He noted the lighting billing for a couple months and also the partial payment to Consumers Energy on the Lansing Road street light installation. Balance of $198,579.86. Kris Morse made a motion to accept the report; seconded by Stacey Matthews. All Ayes.

 

Old Business:

  1. Lansing Road Lighting Project – Several items still need to be addressed as far as the restoration from the underground cable installation for the lighting project. The DDA Board withheld approx. $8,700 until this work is completed. Kathryn from Consumers Energy sent an email to Mark Fulks stating that Floyd Moyers, the Owosso electric field foreman will get with me before this Friday to view the areas of concern. Robert Piro made a motion to pay the balance to Consumers Energy once the restoration work is competed and signed off by two (2) members of the Board (Brian Pfeifle and Joe Audia). Robert Taylor seconded the motion. Roll Call vote: Joe Audia-Yes; Robert Piro-Yes; Brian Pfeifle-Yes; Stacey Matthews-Yes; Robert Taylor-Yes; Adam Elsesser-Yes; Kris Morse-Yes; Mark Fulks-Yes.   2. DDA land – Brian Pfeifle researched the DDA land and gave the Board a report on the money it has invested. Over $58,000 has been spent on the property for cleanup and engineering costs associated with the remediation work on the property.

 

 

New Business:

  1. Newest Member DDA Board – The Board welcomed its newest member: Stacey Matthews.
  2. SEDP update from Justin Horvath – An update was given on a couple projects: A company want to build a 15,000 sq ft building and employ approx. 15 employees. They are an R & D food manufacturing company. They will need access to water and sewer which is not available along the old Lansing Road DDA District. He suggested they may be looking at a piece of property west of the Township property. Joe Audia asked about infrastructure grants from the US Rural Development program and Justin noted that Cristy Cook is our contact. He said he would make contact with her for us. Justin also discussed the relocation of Spartan Fence Company if the PMW (Precision Metal Works) company is able to secure that property. It depends upon the discharge parameters from that company which the wastewater person hired by the Village of Morrice is researching with the DEQ.

Treasurer’s Report/Approval: The Treasurer’s report for the Period 4/1/19 thru 9/17/19 was reviewed and discussed. Kris Morse made a motion to approve; seconded by Robert Taylor. All Ayes. Balance is at $250,109.70.

 

Old Business:

  1. Lansing Road Lighting Project – LIGHTS INSTALLED – discussed the completed lighting project and discussed the traffic accident that took out one of our newly installed lamp poles. A police report was obtained by the Township and given to Consumers Energy for them to secure possible insurance claim. It was noted that Consumers Energy has ordered a replacement pole. Also discussed was the fact that a couple areas where the underground lighting cable was ran has not be restored. Mark Fulks will get with Consumers to get that completed. He also noted that the lamps along Bennett Drive have been replaced according to the completed work orders from Consumers Energy.
  2. Consumers Energy Lighting Project – Final Bill payment ($58,664.55) – the final billing was discussed and it was determined that only a partial payment will occur since the landscaping has not been totally completed. Brian Pfeifle made a motion to pay $50.000.00 for the Lighting Project to Consumers Energy and hold the balance of $8,664.55 until the work is competed. Seconded by Joe Audia. Roll Call vote: Bob Piro-Yes; Robert Taylor-Yes; Adam Elsesser-Yes; Joe Audia-Yes; Brian Pfeifle-Yes; Mark Fulks-Yes; Kris Morse-Yes. All Ayes.
  3. Lansing Road Sign reveal – July 24, 2019 – discussed the unveiling of the sign dedicated to our former Township Supervisor Sid Grinnell and they fact that it was well attended by community members and family members.

 

New Business:

  1. Guy Hubbard, SW Shiawassee Emergency Services Alliance – Brian Pfeifle spoke on his behalf and discussed the possible placement of a new SSESA building along old Lansing Road and the purchase of property near the barber shop.
  1. DDA land for sale – noted that the DDA Board price is around $22,500.00
  2. Vacancy in DDA Board – Stacey Matthews submitted a letter of interest in joining our DDA Board. Brian Pfeifle made a motion to appoint her; seconded by Joe Audia. All Ayes. This will be forwarded to the Perry Township Board.
  3. Shawn Scepka, Scepka Builders – Shawn spoke about working with a business venture dealing with food R & D and sells various items direct to stores and the possibility of expanding to a 15,000 sq ft. building, hiring approx. 15 employees but would need fire suppression and water/sewer connections. The Board discussed water and sewer future and possible USDA, SEDP and other grants. Bob Piro stated that if we had enough need, we would be more inclined to pursue future water/sewer expansion.
  4. Spartan Fence – discussed the fact that PMW (Professional Metal Works) is looking at purchasing both buildings/property from Spartan Fence. Spartan would relocate. A meeting occurred at PMW’s location on Bath Road with the SEPD, PMW, Steve Hughes from the Morrice lagoon and Mark Fulks to discuss discharge levels from PMW and if the levels are acceptable. Steve will get with the DEQ staff person and review previous monitoring reports from PMW and get back to us.

Treasurer’s Report/Approval: Brian Pfeifle gave a detailed DDA income/expenses report for the period 1/1/19 thru 4/16/19 with a balance to date of $234,140.65. He stated that approx. $58,000 is still due Consumers Energy when the Lighting Project is completed.  Mark Fulks made a motion to accept the report as presented; Kris Morse seconded. All ayes.

 

Old Business:

  1. Lansing Road Lighting Project – Mark Fulks noted that Joel Himm from Consumers Energy has given a couple updates on the Project over the past couple months. The LIGHT POLES/LIGHTS ARE BEING INSTALLED!!! Mark also noted that he has had discussions with Kathryn Burkholder, Consumers Energy, Consumer Affairs Manager for our area regarding the dedication sign they are providing to the Township for installation along the Lansing Road near Elsesser’s Garage. Mark also got with the Road Commission who will provide a permit to us for the sign.

 

New Business:

  1. Election of 2019 Officers – Nomination for Officers was opened by Chairman Bob Piro; Nomination for Chairman: Brian Pfeifle made a motion to nominate Bob Piro for Chairman, second by Mark Fulks. All Ayes.   Nominations were opened for Vice Chairman: Bob Piro made a motion to nominate Adam Elsesser, seconded by Brian Pfeifle. All Ayes.       Nominations were opened for Treasurer: Rob Piro made a motion to elect Brian Pfeifle for Treasurer, seconded by Angie Falzon. All Ayes. Nomination for Secretary: Bob Piro made a motion to elect Mark Fulks for Secretary, seconded by Brian Pfeifle. All Ayes.

 

  1. SEDP letter from Justin Horvath was presented to the DDA Board for review. It was a contact sheet for the SEDP and used as a membership contact update.

 

  1. Vacancy in DDA Board – one (1) vacancy exists on our DDA Board and it was suggested that we look at a business owner and a family practice along Lansing Road. Brian will discuss joining with the business and Mark will discuss joining the DDA with the doctor. It was noted that two (2) members were sworn in before our meeting tonight: Angela Falzon – term expires 3/2023 and Kris Morse – term expires 3/2021.

 

  1. DDA land for sale – Lansing Road – Justin Horvath outlined a discussion he had with an interested party to purchase the one acre property at 2400 W Lansing Road to use as a staging area for transport trucks from Crest Pontoons in Owosso, MI. Troy Parmalee our Township Treasurer and Justin met with Jason Gardiner from Custom Transporters in Ohio at the property site last Saturday. Troy presented (via email) a history of the property and Brian gave the DDA involvement in the deeding of the property to the DDA and the remediation that occurred years ago. The property has a restrictive covenant and non-residual land use from the DEQ.       It was decided by the DDA Board to have Justin made a phone call to Mr. Gardiner during our meeting and present the DDA Board purchase offer to him. Brian Pfeifle made a motion to sell the property at 2400 W. Lansing Road, Perry, MI. for $22,500 with buyer assuring all legal/closing costs. Seconded by Angie Falzon. Roll Call vote: Bob Piro-yes; Kris Morse-yes; Adam Elsesser-yes; Angie Falzon-yes; Mark Fulks-yes; Brian Pfeifle-yes. All Ayes.

Justin called Mr. Gardiner and the DDA Board discussed his use of the property and required needs. Our bid/offer was substantially more than he wanted to pay and the Board told him that we thought that was a fair price.  Bob Piro suggested that the  Board might look at a lease/purchase option on the property and he was more interested in that proposal.  The Board told him they would explore this option with our Township Treasurer and others and Justin could get back with him.

 

 

  1. Recodified Tax Increment Financing Act (ACT 57) of 2018. The new Act was discussed with the DDA Board. Mark Fulks attended an MTA conference on the subject in Grand Rapids last month and discussed the requirements of this standard. Our Clerk and Treasurer have completed all the requirements due on April 1, 2019 and are on the DDA section of our Perry Township website, as required by this Act.

The DDA Board also outlined some DDA Accomplishments; DDA Activities & Goals and DDA Explanation of Revenues which will also be posted on our website.

Approval of the Minutes from the October 18, 2018 meeting: The minutes were reviewed and a motion to approve by Adam Elsesser; seconded by Robert Taylor. All ayes.

 

Treasurer’s Report/Approval: Brian Pfeifle gave a detailed DDA income/expenses report for the period 10/1/18 thru 1/15/19 with a balance to date of $233,302.30. Angela Falzon made a motion to accept the report as presented; Joe Audia seconded. All ayes.

 

Old Business:

  1. Lansing Road Lighting Project – Joel Himm from Consumers Energy updated the Board on the road project. The 38 POLES ARE IN!!! and he noted that the job is progressing with a couple changes to the scope including the underground cable/wire being run in PVC conduit; silt fencing being installed along the trench areas. He noted that there would be no additional cost to the Township. He discussed that the steel poles are installed with a large auger that goes into the ground approx. 6’ and the poles do not require concrete, etc. for securing them into the ground. He also noted fuses are installed on each pole to allow for easy repair (if required) without the other lights going out while being worked on.
  2. Joe noted as of this date the completion date, subject to change, is 2/7/19. We discussed the dedication sign to honor Sid Grinnell for his effort on this Road Project. Joel noted that we could not put the bronze plaque on one of the poles and discussed a bench (with the plaque) near the site or a post with the plaque near one of the ends of the Project. Mark Fulks noted that he had contacted the Road Commission and they stated that the bench idea would not work; but will issue the Township a permit for the post with the plaque. Consumers will proceed with the post and plaque so it can be installed for the Dedication of the Project.

New Business:

  1. 2019 Budget Information/Approval – The new 2019/2020 DDA Budget was reviewed and discussed by Brian Pfeifle. He noted that he met this week with Troy Parmalee, Township Treasurer. Brian noted that we had come in ‘under budget’ the last year and stated this years’ budget as presented is basically the same as last year at $168,100.00. He noted that the only cost still outstanding is the balance owed to Consumers Energy for the last payment on the Lansing Road Lighting Project for $58,664.55. Bob Piro noted that this should be separately noted in our budget and, if needed, deduct it from our “Contingency” line item in the Budget. A motion was made by Brian Pfeifle to establish a line item for $58,664.55 for the Consumer Energy final bill; seconded by Bob Piro.   1. DDA Membership renewals – it was noted that Angela Falzon and Don Todd terms will expires on 3/31/19 and need to submit letters to the Township Board before their Monthly Board Meeting which is March 6, 2019.
  2. New Member to DDA Board – a vacancy exists on our DDA Board and it was suggested that we extend a welcome to Kris Morse who moved into our Industrial Park a short time ago.       Mark Fulks noted that he would visit Kris and see if he would be interested in joining the DDA Board.
  3. Medical/recreational marijuana establishment(s) as it applies to the DDA – The Perry Township Planning Commission members has a meeting tonight as well, and they joined our DDA meeting to interact with us on the MJ (marijuana) discussion. A brief history of the State of Michigan MJ laws and ballot initiative was given by Mark Fulks and discussion centered around the DDA Boards’ thoughts on allowing a MJ establishment in the boundaries of the DDA properties. Each of the DDA members gave their ideas and thoughts on the subject. The majority of members suggest we that a “wait and see” attitude allowing the State of MI to develop the laws by Dec. 6, 2019 and see what the county zoning board and county commissioners draft or pass down the road.
