The Construction Board of Appeals (CBA) is a local body that provides a fair and impartial process for individuals to appeal decisions related to building construction, code enforcement, and permitting. The Board helps ensure that construction codes are applied correctly while allowing for reasonable interpretation when unique situations arise.

What the CBA Does

The Construction Board of Appeals is responsible for:

  • Hearing Appeals of Code Decisions: Reviewing appeals from property owners, contractors, or other parties who disagree with decisions made by building officials regarding construction codes or permit requirements.
  • Interpreting Construction Codes: Providing clarification on how building, electrical, mechanical, or plumbing codes should be applied in specific cases.
  • Reviewing Alternate Materials and Methods: Considering requests to use alternative materials or construction methods not specifically outlined in the code, as long as they meet the intent and safety standards.
  • Ensuring Compliance and Safety: Upholding the intent of construction codes to protect public health, safety, and welfare, while also ensuring decisions are reasonable and consistent.
  • Providing Due Process: Offering an open forum where applicants can present evidence and testimony, ensuring transparency and fairness in decision-making.

The Construction Board of Appeals operates in accordance with applicable Sate of Michigan laws and adopted construction codes, and all meetings are conducted in compliance with the Open Meetings Act to ensure public access and participation.

Through its work, the Board supports safe building practices while offering a balanced approach to resolving disputes and interpreting construction regulations.
